General Terms and Conditions
Unless otherwise agreed, the following conditions apply: Insofar as the general and special terms and conditions do not contain any regulations, the Swiss Code of Obligations applies.
Contract:
The contract between the customer and Spycher-Handwerk AG shall come into effect through the customer’s order and its acceptance by Spycher-Handwerk AG. The order can be placed by store order, by e-mail, by letter/order card or by telephone.
Prices
The value-added tax is – unless otherwise stated – included in the prices, price changes and errors excepted!
Terms of delivery
We send our goods with the Swiss Post only within Switzerland.
Goods can also be picked up directly from the Spycher Handwerk in Huttwil.
Delivery time:
Events of force majeure release us from the compliance with the delivery times mentioned. An order is considered delivered when the goods or the consignment has been handed over to the post office or has been picked up in the store of Spycher Handwerk AG.
Delivery control
The delivered goods are to be checked by the buyer upon receipt. Complaints regarding weight or number of pieces as well as notices of defects regarding the condition of the goods must be made immediately after receipt of the goods.
Right of return
Faultless goods that do not meet the expectations of the buyer will only be taken back within eight days after delivery. Custom-made products as well as special measurements (work order) will neither be exchanged nor taken back.
Default of payment
If the buyer does not adhere to the specified terms of payment or if he becomes insolvent, all our credit balances against him, no matter what the agreed payment dates are, become due for payment and can be claimed by us immediately. We are also entitled to cancel without notice all orders already confirmed to the buyer but not yet executed or in execution.
Liability of the seller
In the event of justified complaints or notices of defects, our liability is limited to the replacement of the rejected or defective goods free of charge or the repayment of any advance payments already made. Beyond that the buyer has no further claims against us. The mandatory provisions of the Federal Product Liability Act remain reserved. From verbal information given by our personnel, the buyer cannot derive any assurance for properties of the material for the application in the individual case and thus no liability on our part.
Place of performance and jurisdiction The place of performance and exclusive jurisdiction for all disputes arising in connection with our deliveries is Schwyz (SZ).
